Membership Agreement: Pre-Opening Refund Policy

Organization Name: Okanagan Pickleball Playground Club (“The Playground")

Jurisdiction: British Columbia, Canada

Status: Registered Not-for-Profit Society

1. Purpose & Allocation of Funds

As a registered not-for-profit society in British Columbia, all membership fees, initiation fees, and security deposits collected are immediately allocated toward facility development, operational readiness, and community programming. Consequently, The Playground maintains a strict financial structure required to ensure long-term operational sustainability.

2. Membership Payment

Membership payments are final and non-refundable after 10 days. At that time, the member’s payment becomes a permanent asset of The Playground.

3. Pre-Opening Refund Schedule

Prior to the official opening date of The Playground, and subject to Section 5 of this agreement, a member may request a refund of pre-purchased membership fees according to the following schedule:

• Within 1 (one) to 10 days of the initial purchase date: eligible for a refund, less a non-refundable $250.00 CAD administrative processing fee.

4. Absolute Prohibition on Transfers

MEMBERSHIPS ARE STRICTLY NON-TRANSFERABLE. Pre-opening memberships, membership fees, and waiting list placements are tied exclusively to the individual applicant. A member may not sell, gift, assign, or transfer their membership rights, applications, or financial credits to any other individual, family member, or entity at any time, whether before or after The Playground opens.

5. Failure to Open, Timeline Extensions, or Operational Changes

If The Playground fails to begin operations in the facility by December 31, 2027, the pre-paid membership fees will be returned to the members less the member's share of the expense incurred in the establishment of The Playground. An accounting of such expenses will be available to all members who have pre-paid membership fees.

6. Written Request and Processing Requirements

To initiate an eligible refund under the periods outlined in Section 3, the member must submit a formal request in writing via email to president@okanaganpickleballplayground.ca.

• The request must include proof of purchase and the original transaction date.
• Approved refunds will be processed back to the original payment method within 7 to 10 business days of written approval from The Playground’s board.

7. Acknowledgment and Binding Agreement

By paying your membership fees, the Member certifies that they have read, understood, and agreed to be bound by the terms of this Pre-Opening Refund Policy. The Member explicitly acknowledges the non-profit status of The Playground and accepts that all rights to a refund terminate absolutely upon The Playground opening for business, and that memberships cannot be transferred under any circumstances.
